ARK AUTOMOTIVE LIMITED - TERMS AND CONDITIONS OF SALE

1. COMPANY INFORMATION

ARK AUTOMOTIVE LIMITED is a company registered in England and Wales with company number 14830510 and whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, UNITED KINGDOM (referred to as "we" in these Terms).

2. PRODUCTS

​

We offer Electric Quadricycles, with The Zero being the primary product available for sale. This vehicle has been designed and manufactured in compliance with EU and UK standards. Legally, The Zero is classed as a quadricycle.

3. PRICING

​

The ZERO is priced at £5,995. The price does not include delivery charges, number plates, vehicle excise duty for 12 months, new vehicle registration fee, road taxes, or insurance.

4. ORDERING AND DELIVERY

​

Orders can be placed through our website's "Order Now" section. Confirmation of your order and delivery date will be communicated via email. Delivery, subject to an additional fee, can be arranged anywhere in the UK. Free pick-up is available at our distribution centre in Castle Donington, Derby.

If you choose home delivery, then once your vehicle is ready for delivery, we will contact you to arrange an exact delivery date for your vehicle. We cannot arrange for the handover of your vehicle until the entire outstanding purchase balance has been paid.

Our delivery partners will request proof of address and proof of identity that match the details on your account. They may take steps to verify and make copies of any documents you provide before they hand over your Zero to you. We reserve the right not to complete the vehicle handover if we cannot identify you as the purchaser. Delivery will not be completed if, on arrival at your address, there is no clear and safe place for our delivery partner to unload your vehicle, or conditions at your home address fail to meet reasonable health and safety standards, or where the delivery would put our delivery partner at risk of injury or death.

5. CANCELLATIONS AND RETURNS
 

If you need to cancel before your vehicle is delivered, we'll issue a refund. After your vehicle arrives, you'll have a 14-day cooling-off period during which you can return the vehicle for a refund.

Exercising your right to cancel your purchase of the Zero involves the following steps:

The vehicle you return must be in the same condition as it was when we handed it over to you - meaning, the same technical state, with the interior, exterior, and mechanics free from any damage. Please note that any processing fees, such as bank or transaction charges, government agency fees, and delivery fees, will be deducted from the refund amount. Upon return, we will inspect your vehicle, and we reserve the right to reduce your refund by any amount needed to restore the vehicle to the state it was in at delivery if there are any discrepancies. You will be responsible for all costs incurred in returning the vehicle to us, including the delivery. It is not possible to return a registered vehicle. All documentation given with your vehicle at delivery should also be returned. If any documents are missing, we may deduct the cost of replacing them from your refund. You are responsible for maintaining insurance and applicable road tax up until the vehicle is returned. Any obligations or liabilities linked to the use of the vehicle that arose while it was in your possession are also your responsibility. We may deduct any costs we incur relating to these matters. This cancellation right applies only to private retail customers (consumers).

6. WARRANTY

​

Your vehicle comes with a one-year vehicle warranty and a two-year battery warranty. The warranty documentation provided with the vehicle provides further details.

7. LIABILITY

​

We are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time of the order placement, you and we knew it might happen.

8. DISPUTE RESOLUTION

​

If you have a complaint about your order, we encourage you to contact us with details of your complaint as soon as possible. You can contact us from our customer service on our website.

​

9. PRIVACY

​

We respect your privacy and commit to protecting your personal data. When you use our website and/or when proceeding with an order, we will collect and process certain personal information from you. We may also share the personal information you provide to us with certain third parties for the purposes described in these Terms. 10. GOVERNING LAW

The laws of England and Wales govern these Terms.

Changes to these Terms

​

We may vary or update these Terms from time to time. Whenever we do so, we will make these changes visible on this page. Where these changes have an impact on the supply of your vehicle or where they affect your consumer rights, and you do not agree with the changes, you are free to cancel your order with us in accordance with your rights set out in these Terms.

Miscellaneous

​

If any part of these Terms is found to be unenforceable, the remaining sections of these Terms will remain in full force and effect. If we delay or fail to enforce any of these Terms, it will not be considered a waiver of our rights, and we may still enforce them at a later date.
